    1) ACCEPTANCE OF THESE TERMS

    These Website Terms & Conditions ("Terms") are a legal agreement between you and Evolv Chiropractic, PLLC ("Evolv," "we," "us," or "our"). By accessing or using our website and related online services (the "Site"), you agree to these Terms and to our Website Privacy Policy. If you do not agree, do not use the Site.

    2) ELIGIBILITY

    The Site is intended for adults. By using the Site, you represent that you are at least 18 years old.

    3) NOT MEDICAL ADVICE; NO DOCTOR-PATIENT RELATIONSHIP

    The Site provides general information about our clinic and services. The Site is not medical advice and is not a substitute for professional diagnosis or treatment.

    Using the Site, submitting a contact form, or booking an intro call does not create a doctor-patient relationship. A doctor-patient relationship is formed only through an in-person (or otherwise appropriate) clinical intake and mutual agreement.

    4) NOT FOR EMERGENCIES

    Do not use the Site for medical emergencies. If you believe you have a medical emergency, call 911 or go to the nearest emergency room.

    5) SCHEDULING AND COMMUNICATIONS

    A. Intro call bookings

    You may be able to book an intro call through Calendly or similar tools. Availability is subject to change. We may reschedule or cancel appointments as needed.

    B. Cancellations / no-shows (intro calls)

    If you cannot attend an intro call, please cancel or reschedule as soon as possible (we request at least 2 hours' notice when feasible). There is no fee for intro-call no-shows unless we explicitly state otherwise in writing.

    C. Future paid visits and cancellation policies

    Paid services, evaluations, or plans of care may have separate policies and consents presented at the time of scheduling or intake. Those terms will govern your paid visits. Our general policy for paid appointments (including evaluations and plan-of-care visits) requires at least 24 hours' notice to cancel or reschedule. We reserve the right to consider extenuating circumstances on a case-by-case basis.

    6) USER CONTENT AND SUBMISSIONS

    If you submit information to us through the Site (including messages, scheduling notes, or form submissions), you agree:

    •       Not to submit sensitive medical details through the Site's general forms or open text fields

    •       Not to submit unlawful, defamatory, harassing, obscene, or infringing content

    •       That you are responsible for the content you submit

    You grant us permission to use the information you submit to respond to you and to operate our business, consistent with our Privacy Policy.

    7) MARKETING TEXTS AND EMAILS (OPTIONAL)

    TO THE FULLEST EXTENT PERMITTED BY LAW, EVOLV'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO USE THE SITE (IF ANY), WHICHEVER IS GREATER.

    13) ARBITRATION AGREEMENT AND CLASS ACTION WAIVER

    PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

    A. Informal resolution first

    Before starting arbitration, you agree to contact us at info@evolvchiro.com and describe the issue and the relief you seek. We will try to resolve disputes informally before either party initiates formal proceedings.

    B. Agreement to arbitrate

    Except as described below, you and Evolv agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site will be resolved by binding arbitration, rather than in court.

    C. Arbitration administrator and rules

    Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (or other applicable AAA rules). The arbitrator will have authority to award any relief that a court could award, consistent with these Terms. Information about AAA and its rules is available at www.adr.org.

    D. Location and governing law

    The arbitration will take place in Dallas County, Texas, unless you and we agree otherwise. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

    E. Class action waiver

    YOU AND EVOLV AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

    F. Exceptions

    This arbitration agreement does not prevent either party from:

    •       Bringing an individual claim in small claims court (if eligible), or

    •       Seeking injunctive or other equitable relief in court for misuse of intellectual property or unauthorized access to the Site

    G. Severability

    If the class action waiver is found unenforceable, then the arbitration agreement will be unenforceable only as to class claims, and the remaining provisions will continue to apply to the fullest extent permitted by law.

    14) NONDISCRIMINATION

    We do not discriminate against any individual on the basis of race, color, national origin, sex, age, disability, or any other characteristic protected by applicable law in connection with services described on or accessed through the Site.

    15) INDEMNIFICATION

    You agree to indemnify and hold harmless Evolv and its owners, employees, and contractors from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Site or violation of these Terms.
